General Provisions.
1.1. This offer is an official proposal from individual entrepreneur Ivanytska Alina Ihorivna, hereinafter referred to as the "Seller," to enter into a sales contract for goods remotely via the online store, hereinafter referred to as the "Contract." The public offer is posted on the official website of the Seller “https://www.teulash.com.ua” (hereinafter referred to as the "Website").
1.2. The moment of complete and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to enter into an electronic sales contract for goods is the fact of payment by the Buyer for the order under the terms of this Contract, within the timeframes and at the prices specified on the Seller's Website.
Terms and Definitions.
2.1. In this offer, the terms have the following meanings, unless otherwise specified by the context:
– "Product" — models, accessories, components, and related items.
– "Online store" — a means for presenting or selling products by entering into an electronic agreement in accordance with the Law of Ukraine "On Electronic Commerce."
– "Seller" — the company that sells the products presented on the Website.
– "Buyer" — an individual who has entered into a Contract with the Seller under the terms outlined in this offer.
– "Order" — the selection of individual items from the list of products indicated by the Buyer during the order placement and payment process.
Subject of the Contract.
3.1. The Seller agrees to transfer ownership of the product to the Buyer, and the Buyer agrees to pay for and accept the product under the terms of this Contract.
This Contract regulates the sale of goods in the Online Store, including:
– The voluntary selection of products by the Buyer in the Online Store;
– The independent placement of an order by the Buyer in the Online Store;
– Payment by the Buyer for the order placed in the Online Store;
– Processing and delivery of the order to the Buyer under the terms of this Contract.
Order Placement Procedure.
4.1. The Buyer has the right to place an order for any product presented on the Website, provided it is in stock.
4.2. Each item can be ordered in any quantity.
4.3. In the event that the product is out of stock, the company Manager will notify the Buyer (via phone or email).
4.4. In the event of a product being out of stock, the Buyer has the right to replace it with a similar model, refuse the product, or cancel the order.
Order Payment Procedure
5.1. Payment is made by cash on delivery upon receipt of the goods at the transport company’s branch in the national currency of Ukraine (hryvnias).
5.2. In case the funds do not arrive, the online store reserves the right to cancel the order.
Terms of Order Delivery
6.1. Delivery of goods purchased in the online store is carried out to the warehouses of transport companies, where the orders are issued.
6.2. Together with the order, the Buyer is provided with documents in accordance with the current legislation of Ukraine.
Rights and Obligations of the Parties
7.1. The Seller has the right to:
– Unilaterally suspend the provision of services under this Agreement in case of the Buyer's breach of the terms of this Agreement.
7.2. The Buyer is obligated to:
– Timely pay for and receive the order under the terms of this Agreement.
7.3. The Buyer has the right to:
– Place an order in the online store;
– Enter into an electronic agreement;
– Require the Seller to fulfill the terms of this Agreement.
Liability of the Parties
8.1. The parties are liable for non-fulfillment or improper fulfillment of the terms of this Agreement in accordance with the current legislation of Ukraine.
8.2. The Seller is not responsible for:
– Change in the appearance of the product by the manufacturer.
– Minor discrepancies in the color scheme of the product due to different color reproduction by monitors.
– The content and accuracy of the information provided by the Buyer during the order placement.
– Delays or interruptions in the provision of services (order processing and product delivery) that occur due to reasons beyond the Seller's control.
– Illegal actions committed by the Buyer using access to the Internet;
– Transfer of the Buyer's network identifiers to third parties.
8.3. The Buyer is responsible for any damage caused by their actions while accessing the Internet.
8.4. In the event of force majeure circumstances, the parties are exempt from fulfilling the terms of this Agreement.
8.5. The parties shall endeavor to resolve all disputes through negotiations.
Other Terms
9.1. The Online Store has the right to make changes to this Agreement, provided that they are published in advance on the website teulash.com.ua.
9.2. The Online Store is created to organize the remote sale of goods via the Internet.
9.3. The Buyer is responsible for the accuracy of the information provided during the order placement.
9.4. Payment by the Buyer for the order placed in the Online Store signifies the Buyer's full agreement with the terms of this Contract.
9.5. The actual date of the electronic agreement is the date of acceptance of the terms of this Contract in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce."
9.6. The use of the Online Store for previewing products and placing orders is free of charge.
9.7. The information provided by the Buyer is confidential and is used solely for the processing of the order.
Procedure for Returning Goods of Proper Quality.
10.1. The return of the product is carried out in accordance with the current legislation of Ukraine.
10.2. The return of the product to the Online Store is at the Buyer’s expense.
10.3. In the event of a return of goods of proper quality, the Online Store refunds the Buyer the amount paid, minus the costs associated with the delivery of the product.
Term of the Contract.
11.1. The electronic contract is concluded upon receipt of the acceptance.
11.2. The Contract may be terminated by mutual consent of the parties before the actual delivery of the product.
11.3. The parties have the right to terminate the contract unilaterally in the event of non-fulfillment of the terms of this Contract or on the grounds provided for by the current legislation of Ukraine.
Please note that the Online Store "teulash.com.ua" has the right to grant other individual entrepreneurs and legal entities the right to use the online platform for selling products.
